Blogs By Design Simple Terms & Conditions

Please read the following to better understand our terms and conditions for building your website.

  1. Payment is up front. We cannot build without payment in full. If we build first and then bill you, you could change all the passwords and not pay us. We would have no choice but to pursue legal recourse.
1a. Payment is via Paypal. We send you an invoice by email, which you in turn pay through Paypal. You do not need a Paypal account. You can pay by Transfer, Wire, Credit Card, Debit Card, etc., and your information is not revealed to the seller (us).
  2. We build on your hosting account. The WordPress platform requires using a MySQL Database. A static site (html) can be built offline and uploaded when finished. This is different. The process for moving a site attached to a database is more complicated and time consuming. Problems can arise. By building on your hosting account, you do not pay for the extra time involved with moving the site.
  3. We have different levels of sites and will build your site accordingly, but once we are done, we step back and you take over. We provide a basic training manual to get you started. The manual will probably be all you need for a long time to come.
  4. If you do not wish to take care of the site (adding content, maintenance, etc.), we can do that for you for additional fees, either case by case (where a minimum charge would apply), or with a monthly charge. Keep in mind that the intent here is to build your site and put you in the driver’s seat so you don’t have to pay someone to make changes to your site. But, if you are too busy, we can handle that for you. It’s an option.
  5. Things change. Software has to be updated from time to time. WordPress needs to be updated, often for just tiny security issues. Plugins need to be updated from time to time. All of this can be done through your admin panel. Plugins could become obsolete. We try to include the best and most useful so that updates will be available. We include a plugin for backups so that if anything goes wrong, you have backups to restore your site. That will be up to you. (Do not update the theme, as it may break your layout. If something goes awry there eventually, call us!)
  6. Security is not guaranteed. We do everything we can to make your site secure and deter hackers, but we cannot guarantee security. No one can. If someone tells you they can guarantee security for your site, RUN! That said, many hosts offer these services in the way of software. Read their terms to see what is covered and what is not. Some firms offer security services, with a restoration option, for a monthly fee. These start around $400 per month. If you keep everything updated and don’t undo what we have done in the background, it is unlikely you will ever have a problem.
  7. Normal use will not break your blog. If you try to make changes to the source code, you could break your blog. If that occurs, we might be able to fix it or we might not. Either way, there will be a fee.
7a. Exception: Sometimes adding a new plugin can cause problems. Plugins are third party software so there is no guarantee every plugin will work with every theme. If you have a problem after installing a new plugin, go into your cPanel and look for the File Manager application. The plugin can be removed there even if you can’t log in to your admin panel. You can drop us an email and we’ll walk you through it. It’s easy.
7b. We lock down your site for security so you should not be able to get to the source code from the admin panel, unless that was arranged ahead of time. Again, if you break it, we are not responsible and we may not be able to fix it. If it is something simple, we’ll just help without charging you, but that must be kept within reason.
  8. If you change the theme on your site, expect the layout (as you know it) to be broken. If we have to put it back, we will charge you for our time.
  9. All premium plugins on your site carry a single site license. That means you can only use that plugin on that one site. In most cases, you can upgrade to a multi-site license.
  10. You cannot sell your site as is. You would have to change the theme and change any content we created. You would not have to change content that you supplied to us to build the site. You can buy the theme yourself, so it can be sold with the site. Our license to use this premium theme extends to our client only, and no further. If you are thinking of selling your business/site, call us. We can supply information to help you stay within rights. You need a license.
  11. We are not responsible for any problems or damage or anything else that might happen to your equipment as a result of adding content to or working with your website. (We have to include that.) The website will not be on your computer anyway.
  12. We are also not responsible for anything that may happen with your web host or registrar. We have no control over those issues. Dealing with your suppliers is your responsibility.
  13. Refunds will not be given for any reason, with one exception. If, for some reason, we cannot fulfill our obligation (build your site), due to circumstances beyond our control (death, serious illness, etc.), you will receive a full refund.
  14. These are simple sites that offer a limited amount of customization. This keeps your cost low. If you have special needs or preferences that go beyond what is offered here, beyond what we discussed, hire a web developer to build a website from the ground up. It will cost a lot more, because it will entail a lot more work on the part of the web developer, but the options will be far less limited.
